This Agreement contains the complete terms and conditions that apply to you in joining, buying, bidding, selling, and all other activities you will make on our website. By using or shopping from this Web site, you agree to be bound by its terms of use and shall comply thereof. This Agreement describes and encompasses the entire agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site, the content and computer programs provided by or through the Site, and the subject matter of this Agreement. Amendments to this agreement can be made and effected by us from time to time without specific notice to your end. The agreement posted on the Site reflects the latest agreement and you should carefully review the same before you use our site.
Use of the Site and Prohibitions
Items not in original packaging or where the installation was attempted are nonrefundable. All returns are subject to a re-stock fee. Re-stock fee waivers are available to Military Members and Veterans. The terms and conditions of returns are as follows:
Within 30 days of purchase, Skip the Warehouse will honor returns in unopened packaging in new condition. Skip the Warehouse will pay the return shipping fees upfront. When we receive the merchandise and after inspection of merchandise, we will issue a refund in the form of the original payment minus return shipping fees and a restocking fee. The minimum restock fee is 10%. Mr. Cool products will incur a 15% restocking fee. All sales of motors, compressors and uncased coils are final. Mini-split air handler sales will incur a 50% restock fee. All motorized damper sales will incur a 50% restock fee.
After 30 days of purchase up to 1 year, Skip the Warehouse will honor returns in unopened packaging in new condition. When we receive the merchandise and after inspection of the merchandise, we will issue a refund in the form of the original payment minus return shipping fees and a 20% restocking fee. All sales of motors, compressors and uncased coils are final. In addition to the customer being responsible for shipping fees, all mini-split air handler sales and motorized dampers will incur a 50% restock fee.
After 30 days from purchase date, Motor freight shipments become non-refundable. Customers are responsible for a 20% restock fee and return shipping fees for all motor freight shipment returns.
Faulty Products:
If the goods are faulty, we will meet our obligations under the applicable laws.
If you dispute a credit card charge and lose the dispute you are not entitled to any refunds unless the products are returned to us. Once they are returned, we will issue you a store credit to be used for future purchases.
We do not warrant those product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered on our website is not as described, your sole remedy is to return it in unused condition.
WARRANTIES ARE VOID AND INVALID WHEN IT HAS BEEN DEEMED BY MANUFACTURER TECHNICAL SUPPORT THAT INSTALLATION PROCEDURES, INCLUDING SAFETY PROCEDURES, WERE NOT FOLLOWED IN ACCORDANCE WITH MANUFACTURER GUIDELINES.
We make no express or implied warranties or representations with respect to the Program or any products sold and offered in our website (including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. This site and its information, contents, materials, products and services are provided on an “as is” and “as available” basis. You and understand and agree that your use of this site is at your own risk.
Non-Waiver
Failure of the Skip The Warehouse to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed a relinquishment or waiver of any rights or remedy that the we may have, nor shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.
No waiver by either party of any breach of any provision hereof shall be deemed a waiver of any subsequent or prior breach of the same or any other provision.
Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Pennsylvania, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.
The entire agreement between the parties with respect to the subject matter hereof is embodied on this agreement and no other agreement relative hereto shall bind either party herein.
Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this Agreement, without liability to us. However, we may assign this Agreement to any person at any time without notice.
In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.
IF YOU ARE A HOMEOWNER, YOU MUST HAVE ALL EQUIPMENT INSTALLED BY A LICENSED CONTRACTOR WHO IS FAMILIAR WITH THE EQUIPMENT. DO NOT ATTEMPT TO INSTALL ANY EQUIPMENT YOURSELF UNLESS QUALIFIED TO DO SO. IMPROPER SERVICE, MISAPPLICATION OR INSTALLATION OF PRODUCTS SOLD BY SKIP THE WAREHOUSE OR ITS AGENTS CAN RESULT IN PERSONAL INJURY, PROPERTY DAMAGE, AND/OR EQUIPMENT DAMAGE AND/OR LOSS OF WARRANTY FOR WHICH SKIP THE WAREHOUSE AND ITS SUPPLIERS WILL NOT BE HELD LIABLE.
PURCHASER HEREBY ACKNOWLEDGES THAT FEDERAL LAW PROHIBITS OPENING THE REFRIGERATION LINES OF ANY EQUIPMENT PURCHASE. A PROPERLY LICENSED PERSON MUST HANDLE THE REFRIGERANT CONTAINED IN ANY UNIT/SYSTEM. PURCHASER HEREBY ASSUMES FULL RESPONSIBILITY FOR THE SAFE AND PROPER INSTALLATION OF ANY UNIT/SYSTEM IN ACCORDANCE WITH APPLICABLE LOCAL CODE REQUIREMENTS.
ANY PRODUCT LISTED AS AVAILABLE FOR PURCHASE ON THIS SERVER IS PROVIDED "AS IS" AND "AS AVAILABLE" AND MAY INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. All furnaces/ignition controls purchased from Skip The Warehouse where there is improper installation or misapplication can result in loss of warranty, equipment damage, personal injury, or death. By purchasing from Skip The Warehouse, you agree to not hold responsible Skip The Warehouse or the product manufacturers for any damages, liability or legal litigation for any consequences, damages or injury that results from improper use or installation.
Do not attempt to install the furnace/ignition control unless you are a qualified, licensed heating contractor. All work must be done in accordance with local building, electrical and mechanical codes. All products must be installed according to manufacturer’s installation instructions and safety guidelines.
Step 1: Installing contractor is required to troubleshoot the defective unit/part. This may require contacting the respective manufacturer technical support line. When contacting the manufacturer, document any reference or case numbers as they will be needed for warranty resolution.
Step 2: Homeowner or Installing Contractor will complete the Warranty Claim form located on the website at the bottom of the home page.
Step 3: Skip The Warehouse will issue a return label to customer or schedule a truck to come pick up defective part. Customer is responsible for return shipping costs. In order to expedite the process, customer has the option to purchase the replacement part and will be issued a credit for that purchase upon receipt of defective item less shipping costs.
Step 4: Upon receipt of defective unit by Skip The Warehouse, Skip The Warehouse will issue a credit to the customer less any shipping costs or ship a replacement unit/part to the customer.
